today that targets discrimination at the workplace. and the oakland a's could be playing all of their home games at at & t park in san francisco. we'll tell you why the team according to one report could be ditching the coliseum and moving across the bay. good morning. we want to take you out to san francisco. this is actually considered one of the most dangerous intersections in the city you can see how fast cars travel through that area. this is octavian market. fatal accident overnight. a man in a wheelchair. we will take you out there in a moment. thank you for waking up with us on this monday morning november 4th i'm pam cook. >> and good morning, i'm dave clark. let's check weather and traffic. steve how does it look? >> it looks clear and cold for some. a little breezy for others. rate be sunny today -- it will

be sunny today. clear. there is any huge difference in some of the lows here. clear and cold, breezy. sunshine today. it will be breezy at times but some of the higher elevations as well about 20-30 miles an hour. about 15-20 out to the valley. temperatures 53 antioch. 33 santa rosa. so huge spread here. redwood city 40. san jose 43. livermore 41. concord has tipped to -- has dipped to 39. we'll have a high of 64 degrees. temperatures will be reflective of a little bit of a north breeze but again its tough to get above 70-72 this time of year. sunny, breezy. northerly breeze. but temperatures upper 50s and low 60s. a lot of upper 50s to low 70s. we are looking at a commute on a monday that is easing into the main part of it. we don't have a lot to talk about which is good. this is a look at the east

shore freeway. of course we watch it very closely because when it changes it happens very closely. no problems a the the bay bridge toll plaza. the traffic looks good as you drive through. no major problems this morning. and on the peninsula highway 101 is looking good. so is 280. let's go back to the desk. the san francisco onramp to 101 in octavia is open again. after an overnight collision that killed a man in a wheelchair. ktvu katie utehs talked to investigators. she is back now with more details on what happened in this continuing investigation. >> reporter: this is an absolutely notorious intersection. the man in the wheelchair was traveling east on market. so toward downtown. you step out of the way you can see how busy this intersection is. the driver was coming down octavia toward the 101 onramp when he struck the man crossing

into the crosswalk. as we move over you can see some of the debris still in the roadway. along with those orange paint markings that mark where that wheelchair landed. let me show you video of the scene as san francisco police department photographed the wreckage. the man crossing in the wheelchair died at the hospital shortly after the midnight collision. it took several officers to load his custom wheelchair into a police truck. but they have not released any detills about the victim. the driver of the car involved in the crash stayed on scene. he did not want to be interviewed. and police are not releasing any details about him either. but from what i saw he appeared to be wearing a security guard jacket. he seemed shaken but coherent. the car has damage on the passenger side bumper. investigators would not say if the driver was speeding or who had the right of way. >> we had a fatal collision

involving a vehicle and a person in a wheelchair. and the rest is under investigation. >> reporter: investigators closed the onramp for nearly four hours. we watched many drivers coming down octavia toward the freeway who slammed on their brakes as they were confused by the closure. cycling activists call this one of the most dangerous intersections. back out here live you can see some of the efforts made to catch speeding drivers that run the lights. there are cameras all over this intersection. and there are new cameras in place that could get red light violators who turn right on to market and those violators could face a $238 fine. police investigators say they are using cameras from this intersection to help them solve what happened this morning. and what led up to the fatal collision. live in san francisco katie utehs ktvu channel 2 news. today the family of a santa rosa teenage aerofatally shot

by -- teenager fatally shot by a sheriffs deputy is suing the county. 13-year-old andy lopez was shot and killed while carrying a toy gun that looked like an assault rifle. the civil rights lawsuit claims the sheriffs department encourages the use of deadly force even when there is no threat to public safety. the sheriffs office says the investigation is still too early and calls the lawsuit premature. new information about the man accused in that deadly lax shooting friday morning. the roommates of paul ciancia says he sent a texas to his family that -- a sent a text to his family that he was going to commit suicide. his family went to check on him but they were too late. right now ciancia is surrounded by armed guards and heavily sedated in the hospital after being shot four times by police. the tsa is telling us new

information about how many guns are brought into airports just one week before that deadly shooting president guns were -- 39 guns were seized at airport check points. of those guns 32 were loaded. besides the guns the tsa has intercepted knives, stun guns, and grenades from being taken on to planes. >> i certainly hope it wasn't anything with malicious intent. it was just a mistake and a one off kind of situation. >> tsa says most people say they forgot they had the weapon in their carry on bags. others try to disguise them as ordinary objects trying to sneak them through. the u.s. senate takes a test vote on legislation that would prohibit employers from discriminating against workers on the basis of sexual orientation or gender identity. harry reid says he expects to get the necessary votes to move ahead on the legislation. current federal law prohibits

discrimination. but it does not stop an employer from firing or refusing to hire workers because they are gay, lesbian, bisexual, or transgender. president obama wrote a piece in the post last night showing his support for the employment nondiscrimination act. the president wrote quote does it make a difference if the firefighters who rescued you is gay or the accountant that does your taxes or the mechanic that fixes your car? there are new developments in the fights to stop one of the biggest evictions in san francisco history. the san francisco examiner reports the city has suspended a permit for renovations to an apartment building on market street. the building was being converted into office space after the city said it was not zoned for residential use and dozens of people now face eviction. the oakland a's could be moving across the bay to play their home games at the home of the san francisco giants.

alex savidge is joining us live. he is at at & t park to tell us what is behind this stunning news for bay area baseball fans. >> i have to tell you we already choked in with oakland a's fans and they do not like the idea of watching their team move across the bay to play their games here at at & t park in san francisco. but according to a report from the san francisco chronicle there is a very real possibility that this could happen in the next couple of years. now the issue here is coliseum officials haven't been able to reach a short-term lease agreement with the a's. if no deal is reached major league baseball would help the a's make a move to at & t park for the next two seasons. the league is demanding that the coliseum authority in oakland give the a's just a two- year lease extension and not a longer deal. this report that is out suggests that am shorter lease would give the a's owners more flexibility to move the team possibly to san jose or out of the bay area to another city.

now this morning a's pan phans are waking in on the idea of their -- are weighing in on the idea. >> it would be horrible. its like taking the heart out of oakland. >> you don't want to see it? >> no. definitely not. keep it in oakland. >> its horrible. it really wouldn't be the same. the a's are here. the oakland athletics. oakland. it wouldn't be the same. it really wouldn't opinion >> now the san francisco giants would still have to give the okay for this stadium sharing agreement to become a reality. according to the chronicle's report team president larry bear has declined to comment on this idea. and of course there would be the logistics of all of this. the giants and a's have home games on the same date nine times next season. so that could potentially be quite a few double headers. live this morning in san francisco alex savidge ktvu channel 2 news.

san jose city council would make a decision soon on where and when a softball complex would be built. property south of east ridge mall would be ideal. others say the county fairgrounds on tully road would support more fields. this will be debated tuesday night at the city council meeting. the $228 million measure p park bond was approved 13 years ago. the forest service is preparing for the possibility of devastating mud slides in yosemite national park. roads and trails are being stabilized to keep burned soil from sliding away in heavy rain. signs are also being posted to warn park visitors about falling rocks and trees. soil conditions are also closely monitored. it supplies water to san francisco. time is 5:10. a possible new clue into the disappearance into a man in san

that it like lie ben laden didn't build his compound. new york university student was trapped for two days he was wedged if a space only two feet wide. he disappeared saturday morning after someone pulled the fire alarm. when friends couldn't find him they started searching door to door and they asked nyu security guards to check the rooftop. when they looked over the edge they saw him wedged between the two walls. >> they would have not have found him for who knows how long and he probably would be dead right now. >> the firefighters broke through am cinder block road to rescue him. he is listed in good condition. he was taken to the hospital

for treatment. the investigation into how he became wedged between the walls continues. new information about the profootball investigation of alleged bullying on miami dolphins against the former stanford football star. lineman jonathan martin left the dolphins and still has not come back. he was upset because several of his teammates allegedly pulled a prank on him in the team cafeteria. the nfl is now reporting that the dolphin guard richy has been suspended indefinitely while the national football league and the dolphins investigate the bullying allegations. martin is an offensive tackle. he played for stanford cardinal two years ago. later today president obama will get a visit from his hometown hockey team. the president has invited the chicago black hawks to the white house to celebrate their latest stanley cup victory. the black hawks defeated the bruins in june to win their second championship in the past

26 oakland hills. point rays 3. a little breezy. again it was a cool breeze. monday morning we will get a northerly breeze. 20-30 miles an hour. out to the valley maybe 15-25. especially sacramento valley. clear skies after yesterday's system went through. and it was interesting now people wearing the jackets. its november it doesn't take long. there is a lot of cloud cover. not a lot of rain. it continues all the way from the great lakes down to texas again. the tropical moisture coming up from mexico has been relentless and continues to send in rain. i mean they have had buckets of rain. if you have travel plans down there it will billion cloudy. 33 santa rosa to 49 fairfield. 36 walnut creek. 41 half-moon day. i did see some 30s there. there is a lot of 30s for the inland areas. 44 ukiah. and 43 down in monterey. we have clear skies and and it are be a sunny nice day.

interest rates there. nearly all the markets across asia and in the pacific closed with losses over night. south korea finished the day down almost three quarters of am percent. taiwan off a half a percent. investor there is seem to be waiting for the u.s. jobs report in october. speaking of the u.s. markets. futures indicate a pretty good opening for the dow, nasdaq, and s & p. that follows decent gains on friday. there is a mixed message about tesla's model s. in atherton tesla's see can makes up 13%. but mostover its success is here in california communities which could mean it will take a little while longer for the car to catch on in other states. >> i want, one pam. >> i do too.

soilure clips. it was a partial eclipse in many places including the eastern united states and even in abu dhabi. but in a few others like kenya it was a total eclipse. they call it a hybrid eclipse. scientists say fewer than 5% of all eclipses are hybrids. its called sea star wasting disease. researchers say it starts as small white legions that cause the limbs to fall off. and in a matter of days the star fish desin grates into a pile of goo. >> they have a represent l effect. they are feeding on muscles. they keep muscle populations in check. >> researchers say sea star

wasting disease not new but its never been so wide spread. previous outbreaks had been geographically isolated where as now its being seen on both coasts. the disease does not seem to be effecting other sea animals. time is 5:25. this week california supreme court will decide if steven glass has a right to be a lawyer here. he was a journalist. he wrote for rolling stone and new republic but it was later proven he made up some of the stories. well now he is suing to be allowed to practice law. the california bar association says his history of public lying does not meet its moral character standards but glass supporters say he has learned from his past and he should be given a second chance. the popular video chairing website youtube now has its own music award show. i think that was m & m. yeah it aired last night from new york city.

that intersection octavia and market where it opened back up. katie utehs is joining us from that area. talking about where people have witnessed the dangerous of this intersection. katie. >> reporter: in just the last ten minutes we witnessed a cyclist speed through this intersection and a traffic officer on a motorcycle pulled that cyclist. there have been other several near misses involving pedestrians as well. the combination of both pedestrians and speeding cars is really a dangerous one. here's what happened this morning. the pedestrian who was in a wheelchair was crossing octavia. he was on market heading east. so heading downtown. the driver was coming from octavia. hit him in the crosswalk and knocked the man and his wheelchair on to 101. and you can see the orange spray point marks on the roadway. that is where the wheelchair

came to rest. >> well, we had a fatal collision involving a vehicle and a person in a wheelchair. and the rest is under investigation. >> reporter: here's what the scene looked like around 3:00 this morning. detectives photographed the intersection and it took several officers to load the custom wheelchair into am police-- into a police truck. the car involved was driven away by a chp officer. the driver of the car stayed on scene. police say as of this morning he is not in custody. we talked to him but he did not want to be interviewed. he appeared to be wearing a security guard jacket. he seemed shaken baeckeol her honor. investigators would not say if he is facing charges or who had the right of way this morning. there are cameras at this intersection. investigators will be reviewing the video. and there are new cameras at

this intersection to help catch red light runners who are making illegal right turns from the interstate on to market. . coming up i will tell you more about the safety measures aimed at stopping all the collision. live in san francisco katie utehs ktvu channel 2 news. tonight the clover dale city council will addressth safety of an intersection where two boys were hit on halloween. its also the same crosswalk where a woman was hill and killed back in july. on halloween the two boys ages 12 and 13 were in the crosswalk when they were hit by a pickup truck. the driver says he didn't see them. now they suffered broken bones. they are recovering and at tonight's meeting the city council will discuss installing four-way stop signs. time is 5:35. we have new information about the alleged gunman and the deadly shooting at lax on

friday. paul ciancia was shot four times by police after he shot a tsa officer and wounded four other people. before he went to the airport he sent a text to his family saying he was going to commit suicide. the family went to the house but got there 4578 minutes after he left for the -- 45 minutes after he left for the airport. >> all the nsa findings that came out this year he was upset about it and also thought that tsa abused their power. >> this morning ciancia is heavily sedated and is in the hospital and being watched around the clock by armed guards. birmingham airport is open again. an employee found a note in the mens bathroom and said a bomb

was in the airport terminal. the building was evacuate the. bomb sniffing dogs were brought in. the threat turned out to be false. passengers were allowed to return two hours later. tomorrow local elections will be held and in one city a gun control proposal that is sparking controversy is on the ballot. janine de la vega is joining us live. she is in sunnyvale now. what is it all about janine? >> reporter: its called measure c and tightens gun control in the city. opponents say sunnyvale already has a low crime rate and the ordnance isn't needed. but supporters say that this measure is all about trying to prevent another mass shooting, injuries, and accidental death. measure c would require a gun owner to report to police more than 48 hours if their firearm is lost or stolen.

it would require those that sell ammunition to log and track sales. the push is being led by the mayor saying he wants to minimize risk to families from stolen, improperly secured, or incapacitated weapons being in the wrong hands. opponents say it will not stop shootings instead it would generate lawsuits. we reached out to both the mayor and the gun store this morning to talk about the issue and we're still waiting to hear back from both of them. reporting live janine de la vega ktvu channel 2 news. we have new information on the desperate search for a missing man in san francisco. police now hope a surveillance photo from a a mcdonalds restaurant could provide an

important lead in this new case. it was taken on halloween. it shows a man using a credit card belonging to 23-year-old paulo netto. several days earlier his mother and sister in brazil received a panicked phone call from him. >> saying he was in trouble and some people were following him. and he was hiding from those people. >> reporter: netto has been missing for a week. his family is now in san francisco and hired a private investigator to look for the man in that photo and help out in the search. a man accused of killing a federal investigator is due in court today. randy alana faces life in prison without the possibility of parole. police found her body in vacaville back in august nearly am week after she was reported

miss -- nearly am week after she was reported missing from her home. two dated briefly 20 years ago. time is 5:39. today students at a novato school district will go back to class and campus security will be tighter. surveillance cameras were installed at four middle and elementary schools. these cameras are on the exterior of the buildings. they are not inside the classrooms or bathrooms or other buildings. the school district says the cameras will help keep students safer and also discourage damage to school properties. eastern span of the bay bridge will start to come down soon. crews have started to begin the demolition part of the new structure since the new span opened on labor day weekend. the demolition has been divided into three parts and you the

welcome back. time is 5:43. residents that live near the piedmont avenue want the city to close down a bar after two shootings in a week. a man was shot saturday after getting into a fight on piedmont and mccarthur. the customer was also shot last weekend after walking to his car. the family thanes the bar says that they have installed security cameras and have hired security guards. >> it definitely concerns me. its people's lives and safety at steak. in addition it hurts the reputation of the bar. it hurts the rep station of the -- reputation of the neighborhood. >> the man shot is in critical but stable condition. despite the problems with the healthcare.gov website more americans say they are beginning to understand how the affordable care act effects

them. according to a new poll, 55% of people survey the now say they have enough information to understand the laws impact on their family. that is up 8% from a month ago. a bribery case in san diego could have implications to national security. leonard francis is accused of bribing commanders. they gave him confidential in return and allowed him to dictate ship routes. francis is also accused over charging the navy for food and fuel which his company provided. edward snowden wants the united states to drop charges against him. snowden has been charged with federal crimes for leaking classified u.s. documents. he released a letter to persuade u.s. authorities to

let him off the hook. snowden says he wants to testify before congress about the nsa's surveillance programs. california senator dianne feinstein says he already had that chance. >> he had an opportunity if what he was was a whistle blower to pick up the phone and call the house intelligence committee, the senate intelligence committee and say look, i have information you ought to see. that didn't happen. >> the documents edward snowden released about the surveillance programs around the world have angered some u.s. allies. barts board of directors is expected to hold a special meeting in the next two weeks to vote on a new deal. the contract agreement will keep bart trains running for at least the next four years. the unions voted on friday to approve the deal. the board is now expected to ratify the contract at its next meeting. it calls for a pay increase of 16% over the next four years for barts union workers.

palo alto city council will meet to discuss changes to cal train. they are looking into a study to find out the cost of digging some under passes and trenches. under the new design high speed rail in cal train would share woman tracks on the peninsula. many people say they like the idea of under passes because they are concerned about trains and cars both running at street level. but the california high speed rail authority says it would increase costs and engineering complications. let's get everybody out the door. sal, you taking care of folks at the toll plaza? >> good monday morning to you. things are getting busier. every minute we see more cars showing up and the metering lights will be on soon. westbound backed up for a ten minute delay. the the peek these commutes are usually about 30 minutes. right now we don't have that just yet. we are also looking at the drive on the san mateo bridge and the dumbarton bridge. both those spans continue to look good with no major

welcome back. time now 5:55. cell phone thefts have hit an all time high. police reports say the situation is getting better. the city had 118 cases of stolen cell phones. but in october the number fell to 84. san francisco police say that reduction could be because of police officers in plane clothes patrolling the hot spots for those cell phone thieves. and also the public seems to be more wiser now about how they are using their cell phones.
